The other sub-parts of optional auto insurance under Massachusetts insurance policies provide coverage for bodily injury damages to an individual, a passenger or to another person. These optional insurance coverages include: (1) optional bodily injury others; (2) medical payments; and (3) bodily injury caused by an under insured auto. These three optional insurance coverages are the most important coverage choices under auto insurance policies because these coverages protect an individual and their family. Each of these coverages are addressed separately below.

1. Optional Bodily Injury to Others

This involves the circumstances where an individual is driving their own vehicle, or someone else is driving the vehicle with the individual’s permission, and another person is injured. This may be a result of an auto collision in which the individual is at fault, and the other driver, or a passenger in either vehicle, is injured. The at-fault driver is liable to pay damages to the injured person(s). These damages may include medical costs, lost wages, pain and suffering, permanent loss of function, permanent scarring, etc.

These damages can be significant. It is important to consider the amount of “optional bodily injury coverage to others” that will be sufficient to protect all assets. People with significant income and assets will want to protect those assets by purchasing a high amount of bodily injury insurance protection on an auto insurance policy. Generally, a high limit of $250,000/$500,000 coverage for bodily injury protection is sold by most insurers in Massachusetts. Higher limits may be available from some insurance companies.

2. Medical Payment Coverage

This can be purchased to protect anyone that is injured in an auto collision from medical treatment costs that are not paid by the compulsory Personal Injury Protection coverage or from medical treatment costs that are not paid by health insurance coverage. Again, this coverage offers protection when health insurance is limited, or there is a high deductible or co-payment associated with the health insurance.

3. Bodily Injury Caused by an Under-Insured Auto

This may be the most important optional insurance coverage that can be purchased. It is advised that everyone review this aspect of their auto insurance policy. It is also advised to purchase $100,000/$300,000 coverage.

This coverage protects individuals in circumstances involving an auto collision in which they were not at fault and significant personal injuries were sustained. If the at-fault driver involved in the collision did not have a high amount of “bodily injury to others” coverage, the injured parties may only be able to access $20,000 or $50,000 in insurance coverage from the negligent driver. If injuries and damages are significant, this may not be enough coverage to compensate for the significant injuries.

If “bodily injury caused by an under-insured auto” coverage is purchased, there is a higher insurance coverage available to compensate for injuries and damages sustained. In this case, the negligent driver’s insurance company will pay out the limits of their insured’s coverage ($20,000 or $50,000) and then the injured parties can then present a claim to their auto insurer to cover the remaining damages that were not covered under the negligent driver’s insurance.

Under the optional insurance coverages within Massachusetts automobile insurance policies, every consumer has the right and the option to choose the coverage that best protects themselves and their family. Every insurance company that sells auto insurance in Massachusetts must allow the choice to elect the coverage needed.
