Doctor not giving up challenge to North Carolina's power over health care facilities

A New Bern doctor's lawsuit challenging the constitutionality of the state's Certificate of Need law has been dismissed by a judge in Durham County, but the plaintiff's lawyers say they will appeal the decision.
