Mark Taylor and Anjulie Ponce Receive a $989,000 Verdict in Medical Malpractice Case

Mark Taylor and Anjulie Ponce of Powers Taylor LLP, a Dallas law firm specializing in personal injury and medical malpractice cases, obtained a jury verdict of $989,000 in a case involving the wrongful amputation of their client’s leg.

The Tarrant County jury deliberated one day before finding that the plaintiff, Tanya Valentine, was entitled to the award for medical expenses, loss of earning capacity, physical pain and mental anguish, physical impairment, and disfigurement. The defendant, Dr. John Stasikowski, amputated her leg because he thought she had developed osteomyelitis fourteen months after undergoing surgery to correct a broken ankle. Later testing proved that she had a staph infection, not osteomyelitis. In response, the defense had argued that Ms. Valentine’s pre-existing pain in her ankle was so severe, amputation was still an acceptable recommendation. The attorneys for Powers Taylor relied on the testimony of Ms. Valentine, the defendant, and the testimony of multiple experts to disprove the defendant’s theory.

After the verdict was rendered on February 24, 2017, Taylor said, “We are thrilled with the result, and our client is glad to finally get closure. Although tort reform in Texas medical malpractice law makes these types of cases difficult to pursue, Powers Taylor LLP believes that jury verdicts like this will serve as a reminder that doctors who fail to confirm their diagnoses through readily-available tests will be held accountable for their mistakes.” Judge Tom Lowe presided over the two-week long trial.
