Berman DeValerio Launches Investigation of Fiat Chrysler for Possible Violations of Clean Air Act

Earlier today, the U.S. Environmental Protection Agency (“EPA”) announced that it will bring charges against Fiat Chrysler (NYSE: FCAU) for violations of the Clean Air Act by allowing excess diesel emissions in more than 100,000 vehicles. More specifically, it is alleged that Fiat Chrysler installed software devices in these vehicles which were designed to allow emissions in excess of EPA standards. Affected models include the light-duty model year 2014, 2015 and 2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3-liter diesel engines sold in the United States (the “Affected Vehicles”).

According to Cynthia Giles, assistant administrator for EPA’s Office of Enforcement and Compliance Assurance, the use of such software is a “clear and serious violation of the Clean Air Act” and “threatens public health by polluting the air we breathe.”
