In the ongoing Accent Delight International v. Sotheby’s trial in the United States District Court for the Southern District of New York, a number of allegations are being made against Yves Bouvier which have subsequently been reported widely in the international media.
In response to the allegations being made against him in the trial, Mr Bouvier said:
“Following the debates made in the New York courtroom, and the media coverage they have caused, is like a surreal charade in which people argue over a fraud that was proven to have never happened. All past decisions around the world, including in the US, have unanimously concluded that I was innocent.
These allegations have already been tested and disproven in multiple jurisdictions, including Geneva, Singapore, Hong Kong, Monaco and New York.
David Bitton and Yves Klein, lawyers for Mr Bouvier in Geneva, stated that:
“All the allegations against Mr Bouvier were set aside by prosecutors around the world, and not a single court agreed to open a proper trial to review the accusations. In the latest decision, the Geneva Public Prosecutor's Office stated that it closed the case after conducting a number of hearings ‘which did not provide any evidence to raise sufficient suspicion’ against Mr Bouvier. The order of discontinuance of the Swiss criminal proceedings after six years of investigation corresponds under Swiss law to a judgment of acquittal of Mr Bouvier issued by a Swiss court, which has binding authority. This was a complete victory for our client.”
"It is worth addressing two important misconceptions that are being repeatedly reported in media. First, the allegation that Mr Bouvier was acting as an advisor. The fact that Mr Bouvier was a seller and not an art adviser, as confirmed by signed contracts and invoices, was not contradicted by a single judicial authority during nine years of legal fight in five different countries. Second, the companies, which repeatedly claimed to have overpaid for artworks sold by Mr Bouvier, have never tried to cancel a single sale and have made enormous profits when selling on some of the artworks in question. For example, Accent Delight International Ltd bought the Salvator Mundi for $127.5 million and sold it for $450.3 million."
