An herbal substance with a substantial number of benefits, kratom, is becoming increasingly popular in the United States. The only issue is that, in some US states (and even some cities), kratom is forbidden.

That begs the question: what is the legality of kratom in different states throughout America? What are the states where kratom is illegal?

States Where Kratom Is Illegal

While kratom is legal in many US states, it’s strictly forbidden in a handful. Where is kratom banned in the US? In the following states:

Alabama

Alabama has banned both the selling and use of kratom alkaloids. Any product containing these alkaloids is forbidden in the Yellowhammer State.

Arkansas

Arkansas has banned any and all kratom products. This includes powders, capsules, and beyond.

Indiana

All kratom products are banned in the Hoosier State as well. You can’t legally buy or possess kratom in Indiana.

Rhode Island

In Rhode Island, products containing kratom alkaloids have been banned. You can’t buy or possess them in a legal manner in the Ocean State.

Vermont

As in Rhode Island, products containing kratom alkaloids are banned in Vermont. They can’t be legally bought or possessed.

Wisconsin

Wisconsin has banned all kratom products. You can possess or sell any product containing kratom.

States Where Kratom Is Unregulated

There are a number of states where kratom is entirely unregulated. These states include Alaska, Connecticut, Delaware, Hawaii, Idaho, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, New Jersey, New Mexico, New York, North Carolina, North Dakota, Oklahoma, Oregon, Pennsylvania, South Dakota, Texas, Virginia, Washington, West Virginia, and Wyoming.

States Where Kratom Is Regulated But (Mostly) Legal

There are a handful of states in which kratom is legal but regulated. We’ll discuss these states below, along with the specifics of their kratom regulations.

Arizona

In Arizona, kratom is regulated by the KCPA or Kratom Consumer Protection Act. This simply ensures that distributed kratom products are safe for use by human beings.

Georgia

Like Arizona, Georgia has a KCPA or Kratom Consumer Protection Act. Again, this just ensures that sold kratom products are safe for humans who buy them.

Nevada

In Nevada, there is also a KCPA. So, while you’re free to possess kratom, you can only sell it provided it meets specific guidelines.

New Hampshire

In New Hampshire, kratom is lightly regulated. In particular, it can’t be sold to or possessed by minors.

Ohio

In the Buckeye State, only kratom powder can be sold legally. Pure kratom and other forms of kratom products (such as capsules) can’t be sold or possessed.

South Carolina

South Carolina lightly regulates kratom. It can be sold to and possessed by adults. It can’t, however, be sold to or possessed by minors.

Tennessee

Like in South Carolina and New Hampshire, in Tennessee, kratom isn’t available to minors. Only adults can buy and possess kratom in the Volunteer State.

Utah

Utah has a KCPA or Kratom Consumer Protection Act. Again, this verifies that sold kratom products are safe for human beings.

States Where Kratom Is Unregulated and (Mostly) Legal

There are just a few states where kratom is deemed legal by the state legislature, but where it’s deemed illegal in specific cities. These states include the following:

California

Kratom is legal everywhere in the Golden State, except for in the city of San Diego. Kratom is fully banned in San Diego.

Colorado

Kratom is legal everywhere in the Centennial State, except for in the cities of Parker and Monument. Note that there are also some restrictions to kratom in Denver. In particular, Denver requires kratom products to possess a label containing a consumer advisory warning.

Illinois

In Illinois, kratom is legal statewide, except for in the cities of Alton, Jerseyville, and Edwardsville. It’s strictly forbidden in these cities, both in terms of sale and possession.

Florida

In the state of Florida, kratom can be sold and possessed everywhere, except for Sarasota County. In Sarasota County, it’s 100% forbidden, both in terms of sale and possession.

Mississippi

In Mississippi, kratom is legal to sell and possess everywhere. The exception is Union County, which has banned the sale and possession of all kratom products.

Why Is Kratom Forbidden in Some States?

Now, you might be wondering: why is kratom forbidden in some states? There could be a number of reasons why.

In general, it’s because state legislatures believe kratom to be more detrimental than beneficial. They believe its potential negative side effects outweigh its potential advantages.

On the other hand, it could simply have to do with the lack of regulation of kratom in those respective states. These states might not have banned kratom had they been able to ensure that the ingredients used in kratom products would be safe. Unfortunately, these states opted to ban kratom altogether rather than to do the work of regulating it.

As you can see from above, a good many states have opted to regulate kratom. This is because they can recognize the potential it provides, and thus want to ensure that it’s available to their citizens in a safe manner.

When buying kratom products, you’re strongly advised to purchase them from reputable sellers. Read reviews of them online and make sure that they’re generally positive. Never buy kratom from a random seller or someone off the street.

As long as you’re careful about your kratom purchases, you shouldn’t encounter any problems. This is why regulation is actually a good thing, in many cases. It protects the consumer while also allowing them some freedom of choice.
